1. Scope and Definitions

These Terms & Conditions ("Terms") govern your use of mwizard.live ("the Site"), operated by Mark Turrell, Miquelstr 8, 14199 Berlin, Germany ("we", "us", "our").

Our Privacy Policy is incorporated into these Terms by reference and forms part of the agreement between you and us. By using the Site, you agree to both these Terms and the Privacy Policy. If you do not agree to either, please do not use the Site.

Any document referenced in these Terms (including the Privacy Policy, the Imprint, and any future legal notices published on the Site) is incorporated by reference and forms part of the agreement.

2. What the Site Offers

The Site showcases music, videos, articles, events and related content by the artist [mwizard]. It also provides a contact form, a newsletter signup, individual track landing pages with embedded audio-reactive visualisations, and outbound links to external streaming platforms (Spotify, Bandcamp, Apple Music, SoundCloud, YouTube and similar).

The Site is informational. It does not currently sell goods or services directly. If this changes, these Terms will be updated to add commercial provisions (refund / cancellation rules, consumer-protection rights, payment terms) and you will be notified via the homepage.

3. Age Restriction

The Site is intended for users aged 16 or older. By using the Site, you confirm that you are at least 16 years old. If you are under 16, please do not submit any personal data through the Site.

4. Intellectual Property

All content on the Site — including music, artwork, photographs, videos, text and design — is the property of Mark Turrell or used with permission. You may not copy, distribute, or use this content without prior written consent, except for personal, non-commercial use (for example, sharing a link to a page on the Site).

The name "[mwizard]" and associated logos are trademarks of Mark Turrell.

Outbound link buttons that redirect you to streaming platforms (Spotify, Bandcamp, etc.) are not licences to download, redistribute, or commercially exploit the music or assets found on those platforms — your use of music on those platforms is governed by the terms of the platform.

5. Newsletter

If you sign up to the newsletter, you consent to receiving occasional emails about new music, events and updates. You can unsubscribe at any time by following the link in any email or by contacting us at the address below. We will never share your email address with third parties for marketing purposes.

6. Contact Form

Messages submitted through the contact form are stored securely and read only by the site operator. We will respond where appropriate but are under no obligation to do so.

7. Analytics and First-Party Tracking

The Site uses two forms of analytics, both described in detail in our Privacy Policy:

Both forms of analytics operate on the legal basis of our legitimate interest, as detailed in the Privacy Policy. Your right to object to first-party creative analytics is described in Privacy Policy §7.

8. External Links

The Site contains links to external platforms (Spotify, Apple Music, SoundCloud, Bandcamp, YouTube and others). These are independent services with their own terms and privacy policies. We have no control over their content or practices. Your use of those platforms is at your own risk.

9. Availability

We aim to keep the Site available but make no guarantee of uninterrupted access. We may modify, suspend or discontinue the Site at any time without notice.

10. Limitation of Liability

Mark Turrell is liable without limitation for damages caused by intent or gross negligence, and for damages arising from injury to life, body or health. For slight negligence, Mark Turrell is only liable in case of breach of a material contractual obligation, and in such cases liability is limited to foreseeable, typically occurring damages.

This does not affect liability under the German Product Liability Act (Produkthaftungsgesetz) or other mandatory statutory provisions.

11. Force Majeure

We are not liable for any failure or delay in performance of these Terms to the extent caused by events beyond our reasonable control, including but not limited to acts of God, internet or hosting-provider outages, governmental actions, war, terrorism, or labour disputes. Where such events prevent ordinary operation of the Site, our obligations are suspended for the duration of the event.

12. Survival

The provisions of Sections 4 (Intellectual Property), 10 (Limitation of Liability), 13 (Governing Law), 14 (Severability), 15 (Entire Agreement) and 16 (Assignment) survive any termination of these Terms or your use of the Site.

13. Governing Law & Jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany, without regard to conflict-of-laws principles. The exclusive jurisdiction for any dispute arising out of or in connection with these Terms is the courts of Berlin, Germany. If you are a consumer resident in another EU Member State, mandatory consumer-protection laws of your country of residence continue to apply where they grant you greater protection.

14. Severability

If any provision of these Terms is found by a competent court or authority to be invalid, illegal or unenforceable, that provision shall be deemed modified to the minimum extent necessary to make it valid, legal and enforceable, or — if such modification is not possible — severed from these Terms. The validity, legality and enforceability of the remaining provisions shall not be affected.

15. Entire Agreement

These Terms, together with the Privacy Policy and any other document expressly incorporated by reference, constitute the entire agreement between you and us regarding your use of the Site, and supersede all prior or contemporaneous understandings, agreements, or representations.

16. Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign or transfer our rights and obligations under these Terms in connection with a merger, acquisition, sale of assets, or by operation of law, provided that the successor agrees to be bound by these Terms.

17. Waiver

Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision. Any waiver must be in writing to be effective, and a waiver in one instance shall not constitute a waiver in any subsequent instance.

18. Dispute Resolution

Before initiating formal legal proceedings, you agree to contact us at hello@mwizard.live with a clear description of the dispute and a requested resolution. We will endeavour to respond and engage in good-faith discussions within 30 days. This requirement does not prevent you from exercising your statutory rights, including lodging a complaint with the Berlin data protection authority for privacy matters (see Privacy Policy §8).

The European Commission provides an online dispute resolution platform at ec.europa.eu/consumers/odr. We are not currently obliged to and do not participate in dispute resolution proceedings before a consumer arbitration board.

19. Changes to These Terms

We may update these Terms from time to time. The "last updated" date at the top of this page will reflect any changes. Material changes (in particular changes to Sections 7, 10, 13, or to the incorporated Privacy Policy) will be announced on the homepage for at least 30 days before they take effect. Continued use of the Site after a change has taken effect constitutes acceptance of the updated Terms.
